Yes, weed is legal in Chicago for adults aged 21 and older. Eligible adults may purchase recreational cannabis from licensed dispensaries and possess it within Illinois’ legal limits. However, marijuana cannot be smoked or consumed openly on Chicago streets, in parks, inside vehicles or in most other public places.

Chicago follows Illinois’ Cannabis Regulation and Tax Act, although the city may regulate where cannabis businesses can operate.

Weed Legal in Chicago?

When Did Chicago Legalise Recreational Weed?

Recreational cannabis became legal throughout Illinois on January 1, 2020. Adults aged 21 and older may purchase marijuana from a state-licensed dispensary without having a medical cannabis card.

Buyers must provide valid government-issued identification showing that they meet the minimum age requirement. Cannabis purchased from an unlicensed seller remains illegal, even when the buyer is over 21.

How Much Weed Can a Chicago Resident Possess?

Illinois increased its adult-use possession limits on June 12, 2026. A Chicago resident aged 21 or older may now possess up to:

  • 60 grams of cannabis flower
  • 10 grams of cannabis concentrate
  • Cannabis-infused products containing up to 1,000 milligrams of THC

These limits are cumulative. This means a person may possess legal amounts from each category at the same time, rather than having to choose only one category.

Older articles may still state that Illinois residents can possess only 30 grams of flower, five grams of concentrate and 500 milligrams of THC in infused products. Those were the limits before the June 2026 change.

What Are the Limits for Tourists?

Adults visiting Chicago from another state may also legally purchase and possess cannabis. However, lower limits apply to non-Illinois residents.

A visitor aged 21 or older may possess up to 30 grams of cannabis flower, five grams of concentrate and cannabis-infused products containing no more than 500 milligrams of THC.

A visitor cannot legally take marijuana home across the state border. Transporting cannabis into another state can violate state and federal law, even when recreational marijuana is legal in both locations.

Where Can Weed Be Consumed?

Cannabis may generally be consumed inside a private residence when the property owner allows it. A landlord, hotel, homeowner or condominium association may prohibit marijuana smoking or other cannabis use on its property.

Public consumption is illegal. Prohibited locations include Chicago streets, pavements, parks, playgrounds and areas immediately outside dispensaries. Cannabis also cannot be consumed inside a parked or moving vehicle.

Smoking marijuana is also prohibited anywhere tobacco smoking is banned under the Smoke Free Illinois Act. Businesses may establish stricter rules and remove people who violate their policies.

Can Recreational Users Grow Weed at Home?

No. Illinois does not allow ordinary recreational consumers to cultivate cannabis plants at home.

Home cultivation is limited to Illinois residents aged 21 or older who are registered qualifying medical cannabis patients. A qualifying household may grow no more than five plants taller than five inches.

The plants must be kept in an enclosed, locked area away from ordinary public view and protected from access by anyone under 21. A landlord may prohibit a tenant from growing cannabis on rented property.

Can Weed Be Carried in a Vehicle?

Cannabis may be transported in a vehicle, but it must be stored correctly. It should be inside a secured, sealed or resealable, odour-proof and child-resistant container.

Cannabis generally must also be inaccessible to the driver and passengers. However, marijuana lawfully purchased from a licensed dispensary may remain accessible when it is still secured in its sealed, odour-proof, child-resistant original packaging.

Neither the driver nor a passenger may consume cannabis inside the vehicle. Knowingly violating the vehicle-container rules can be treated as a Class A misdemeanour.

Is Driving After Using Weed Legal?

No. Driving while impaired by cannabis is illegal in Chicago and throughout Illinois. Recreational legalisation does not protect someone from a driving-under-the-influence charge.

Police may consider driving behaviour, physical symptoms, field observations and chemical testing when investigating suspected impairment. A person should arrange a sober driver, taxi, rideshare or public transport after consuming cannabis.

Can Employers Prohibit Marijuana?

Yes. Employers may continue operating drug-free workplaces and may prohibit employees from possessing, using or being impaired by cannabis while working.

Legal recreational use does not give an employee permission to arrive at work impaired. Federal contractors, transport workers and people in safety-sensitive positions may face additional restrictions.

Private property owners and businesses may also prohibit cannabis use anywhere on their premises, including parking areas.

Does Federal Law Still Apply in Chicago?

Cannabis remains restricted under federal law. It should not be possessed on federal property, including certain government buildings and federally controlled land.

It is also unlawful to transport marijuana across state or international borders. A product legally purchased at a Chicago dispensary should therefore remain within Illinois.

The Current Legal Position

Weed is legal in Chicago for adults aged 21 and older, but only within regulated limits. Illinois residents may possess up to 60 grams of flower, while non-residents may possess up to 30 grams.

Cannabis must be purchased from a licensed dispensary, used on permitted private property and transported in an approved container. Public consumption, impaired driving, recreational home cultivation, underage possession and interstate transportation remain illegal.
