Yes, weed is legal in California for adults aged 21 and older. Adults may purchase recreational cannabis from licensed retailers, possess limited quantities, give small amounts to other adults and grow up to six plants at a private residence.
However, legalisation does not allow marijuana use everywhere. Public consumption, impaired driving, unlicensed sales, excessive possession and carrying cannabis across state lines remain illegal.

When Did California Legalise Recreational Weed?
California voters approved Proposition 64, also known as the Adult Use of Marijuana Act, in November 2016. The law legalised personal possession and cultivation for adults aged 21 and older. Licensed recreational sales began on January 1, 2018.
California had already legalised medical cannabis in 1996 through the Compassionate Use Act. Medical use remains available to qualifying patients aged 18 or older who have a physician’s recommendation.
How Much Weed Can an Adult Possess?
An adult aged 21 or older may legally possess:
- Up to 28.5 grams of ordinary cannabis, which is approximately one ounce
- Up to eight grams of concentrated cannabis
- Up to six living cannabis plants
Concentrated cannabis includes products such as wax, resin, hash and certain cannabis oils. The eight-gram limit also applies when concentrate is contained in cannabis products.
Possessing more than 28.5 grams of cannabis or more than eight grams of concentrate outside an authorised exception can be treated as a misdemeanor. A person aged 18 or older may face up to six months in county jail, a fine of up to $500, or both.
Cannabis produced from a person’s legally grown plants may exceed the ordinary 28.5-gram possession limit when it is kept at the private residence where the plants were grown. The excess amount must be stored in a locked space and must not be visible from a public place.
Can Visitors Buy Weed in California?
Yes. California residency is not required to purchase recreational cannabis.
A visitor aged 21 or older may buy cannabis from a licensed California retailer after presenting an accepted government-issued photo ID. A passport, driving licence, military identification card or other approved government ID may be accepted.
Visitors must follow the same possession limits as California residents. They cannot legally take marijuana back to another state or country.
Where Can Cannabis Be Purchased?
Recreational marijuana should be purchased only from a retailer licensed by the California Department of Cannabis Control. Licensed businesses may operate as physical dispensaries or delivery services.
Licensed products must undergo testing and meet state packaging and labelling standards. Some shops that appear legitimate may be operating without a licence and may sell untested products containing pesticides, mould, chemicals or inaccurate THC levels.
Cities and counties may impose additional restrictions. Some California communities do not allow recreational dispensaries within their borders, even though personal cannabis possession remains legal under state law.
Buying from an unlicensed dealer remains illegal. Adults cannot legally sell marijuana privately merely because recreational possession is allowed.
Can You Give Weed to Another Adult?
An adult aged 21 or older may give another adult up to 28.5 grams of cannabis or eight grams of concentrate.
The transfer must be completely free. The person giving the cannabis cannot receive money, goods, services or anything else of value.
A seller cannot avoid licensing laws by charging an excessive price for an ordinary product and claiming the cannabis is a free gift. Such an arrangement may still be treated as an illegal sale.
Can You Grow Weed at Home?
Yes. Adults aged 21 or older may grow up to six living cannabis plants at a private residence.
The six-plant limit applies to the entire residence, not to each adult living there. Therefore, a house containing three adults may still grow no more than six plants at one time.
The plants and any harvested cannabis exceeding the ordinary possession limit must be kept in a locked area that is not visible from a public place.
Local governments may regulate home cultivation. A city or county may require plants to be grown indoors, impose reasonable safety rules or completely prohibit outdoor cultivation. However, local authorities cannot completely ban adults from growing up to six plants inside a private residence or a fully enclosed and secure accessory building.
Tenants should also check their rental agreements. A landlord may prohibit cannabis cultivation or smoking on rented property.
Is It Legal to Smoke Weed in Public?
No. Smoking, vaping or consuming cannabis in a public place is generally illegal.
Public places can include streets, pavements, parks, restaurants, bars, shopping areas and public transport. Cannabis also cannot be smoked anywhere that tobacco smoking is prohibited.
Smoking cannabis within 1,000 feet of a school, day-care centre or youth centre while children are present is restricted, subject to limited exceptions involving private residences and authorised premises.
Cannabis may generally be consumed on private property when the property owner permits it. Hotels, landlords, businesses and homeowners’ associations may establish stricter rules and prohibit smoking or cannabis use.
Some local governments permit licensed cannabis-consumption venues, but ordinary public consumption remains unlawful.
Can Weed Be Carried in a Vehicle?
Cannabis may be transported within California as long as the person stays within the legal possession limits and stores it properly.
An opened package or container cannot be kept in the passenger compartment while someone is driving or riding in a vehicle. Cannabis should remain in a sealed, unopened container or be stored in the trunk or another area where passengers do not sit.
Neither the driver nor passengers may smoke, vape or consume cannabis inside a vehicle. These restrictions apply even when the vehicle is temporarily parked on a public road.
Is Driving After Using Weed Legal?
No. Driving while impaired by cannabis is illegal in California.
The state does not use a simple legal THC limit equivalent to the 0.08 blood-alcohol limit. Police may consider the driver’s behaviour, coordination, physical condition, statements and chemical-test results.
A person can be arrested when cannabis affects their ability to drive safely. Refusing a legally required blood or urine test after a DUI arrest can also lead to suspension or revocation of driving privileges.
A medical cannabis recommendation does not provide permission to drive while impaired.
Can Employers Prohibit Marijuana?
Employers may prohibit employees from possessing, using or being impaired by cannabis while working. They may also maintain a drug-free workplace where permitted by state and federal law.
California provides certain protections for many employees who use cannabis legally while off duty and away from the workplace. Employers generally cannot discriminate solely because a test reveals non-psychoactive cannabis metabolites from previous off-duty use.
However, important exceptions apply. The protections may not cover construction workers, positions requiring federal background investigations or security clearances, and jobs subject to specific federal testing requirements.
Legal recreational use therefore does not guarantee protection in every occupation.
Is Weed Legal for People Under 21?
Recreational cannabis is not legal for people under 21.
A person aged 18 to 20 may use medical cannabis when they have a valid physician’s recommendation. Without medical authorisation, possession of up to 28.5 grams of cannabis or eight grams of concentrate by someone aged 18 to 20 is an infraction carrying a fine of up to $100.
Different education, counselling and community-service penalties apply to minors under 18.
It is illegal for an adult to sell or give recreational cannabis to someone under 21.
Does Federal Law Still Apply?
Yes. California’s legalisation applies only under state and local law. Federal restrictions continue to affect cannabis possession, transportation and use.
Cannabis should not be carried onto federally controlled property, including military bases, federal buildings and many national parks. It also cannot legally be taken across state or international borders.
This means a person cannot legally drive cannabis from California into Nevada, Oregon or Arizona, even though those states also permit recreational marijuana. It should not be mailed or carried onto an interstate or international flight.
The Current Legal Position
Weed is legal in California for adults aged 21 and older. Adults may possess up to 28.5 grams of cannabis or eight grams of concentrate, purchase products from licensed retailers and grow no more than six plants per residence.
However, marijuana must be used on permitted private property. Public consumption, impaired driving, unlicensed sales, excessive possession and interstate transportation remain unlawful.
The simplest legal rule is to purchase cannabis from a licensed retailer, remain within the possession limit, avoid using it in public or inside a vehicle, and never drive while impaired.
