Weed is legal in Oklahoma only for people authorised under the state’s medical marijuana programme. Recreational marijuana remains illegal. Adults cannot legally purchase, possess, use or grow marijuana merely because they are over 21.
Oklahoma voters approved medical marijuana through State Question 788 in 2018. However, they rejected State Question 820, which would have legalised recreational marijuana, in March 2023. No later statewide measure has legalised adult recreational use as of July 29, 2026.
Is Recreational Marijuana Legal in Oklahoma?
No. Oklahoma does not have legal recreational marijuana sales. Dispensaries may sell marijuana only to people holding a valid patient or caregiver licence issued by the Oklahoma Medical Marijuana Authority.
A person without a valid licence may face criminal consequences for possessing marijuana. Under Oklahoma’s controlled-substance law, unauthorised possession is generally a misdemeanour that can carry up to one year in county jail, a fine of up to $1,000, or both. The actual outcome depends on the facts, criminal history and decisions made by prosecutors and the court.
Oklahoma law provides a limited rule for an unlicensed person who possesses no more than 1.5 ounces and can state a medical condition. That offence is punishable by a fine of up to $400 without imprisonment. This provision does not create a right to purchase marijuana from a dispensary or operate as an alternative to obtaining a patient licence.
Is Medical Marijuana Legal?
Yes. Oklahoma residents may apply for a medical marijuana patient licence after receiving a signed recommendation from an authorised physician.
An adult patient licence allows its holder to buy, possess, consume and grow medical marijuana within state limits. Applicants must submit proof of identity, Oklahoma residency, a photograph and a physician recommendation signed within 30 days of the application. Standard adult licences may remain valid for two years, while short-term licences are available for 60 days.
A patient must present a valid OMMA identification card when purchasing products from a licensed dispensary. Law-enforcement officers may also request the card to confirm that the person is legally authorised to possess medical marijuana.
How Much Medical Marijuana Can a Patient Possess?
A licensed Oklahoma patient may legally possess:
- Up to three ounces of marijuana on their person
- Up to eight ounces of marijuana at their residence
- One ounce of concentrated marijuana
- Up to 72 ounces of edible marijuana
- Up to 72 ounces of topical marijuana
- Six mature marijuana plants
- Six seedling plants
Patients may also keep the marijuana harvested from their authorised plants. Possessing more than the permitted amount can fall outside the protections of the medical marijuana programme.
Can Patients Grow Weed at Home?
Yes. A licensed patient may grow up to six mature marijuana plants and six seedlings.
The plants must be grown on property owned by the patient or on property where the owner has given written permission. They must not be accessible to the general public or visible from an adjoining street.
Oklahoma also prohibits patients from using residential extraction processes involving butane, propane, carbon dioxide or other potentially hazardous substances.
People without a patient or commercial licence cannot lawfully grow marijuana at home for recreational use.
Can You Smoke Medical Marijuana in Public?
Licensed patients may smoke or vape medical marijuana outdoors in public areas where tobacco smoking is legally permitted. The same general location restrictions that apply to tobacco smoking also apply to public medical marijuana smoking and vaping.
This does not mean marijuana may be used everywhere. Property owners, employers and businesses can prohibit its use on their premises. Employers are not required to permit employees to possess, consume or remain under the influence of medical marijuana at work.
Can You Drive With Marijuana?
Patients may transport legally possessed medical marijuana within Oklahoma, but consuming it while operating a vehicle is illegal. Oklahoma also prohibits drivers from having an open marijuana container in the passenger area of a moving vehicle.
Driving while impaired by marijuana can result in DUI-related charges even when the driver holds a valid medical marijuana licence. Medical authorisation is not a defence to unsafe or impaired driving.
Can Visitors Use an Out-of-State Medical Card?
An out-of-state medical marijuana card does not by itself authorise possession in Oklahoma. A visitor with a government-issued medical cannabis licence from another state must apply for an Oklahoma temporary patient licence.
The temporary licence remains valid for 30 days and allows the visitor to purchase, use and grow medical marijuana under Oklahoma rules. A recommendation issued only by a doctor is not sufficient; the applicant must hold a medical marijuana licence issued by another state government.
Marijuana cannot legally be taken across state lines, including between Oklahoma and another state where cannabis is permitted. OMMA specifically warns licensed patients not to travel outside Oklahoma with marijuana or marijuana products.
Therefore, weed is not legal for recreational use in Oklahoma. It is legal only for properly licensed medical patients and caregivers who follow the state’s possession, cultivation, purchasing and use restrictions.
